Our website and app use the multi-stage measurement procedure 'INFOnline Measurement' from INFOnline GmbH (https://www.INFOnline.de) to determine statistical parameters (page impression, visit, technical client) about the use of our digital offering.
The goal of usage measurement is to statistically determine the number of visits to our offerings, the number of website visitors and app users, and their usage behavior - on the basis of a uniform standard procedure - and thus to obtain values that are comparable across the market.

As a member of the Informationsgemeinschaft zur Feststellung der Verbreitung von Werbeträgern e.V. (IVW - https://www.ivw.eu) usage statistics are regularly provided by IVW with the performance values 'Page Impression' and 'Visits' in the IVW report (https://ausweisung.ivw-online.de/index.php). As a participant in the agof daily digital facts study, the usage statistics of our digital offering are regularly processed further by the Arbeitsgemeinschaft Online-Forschung e.V. (agof - https://www.agof.de) and the Arbeitsgemeinschaft Media-Analyse e.V. (agma - https://www.agma-mmc.de into reach figures and published with the performance value 'Unique User'.

3.3.4.1. Nature of the data

INFOnline GmbH collects the following data, which has a personal reference according to GDPR:

  • IP address: On the Internet, every device requires a unique address, the so-called IP address, in order to transmit data. The storage of the IP address, at least for a short period of time, is technically necessary due to the way the Internet works. The IP addresses are shortened by 1 byte before any processing and are only processed anonymously. No storage or further processing of the untruncated IP addresses takes place.
  • A randomly generated client identifier: Range processing uses unique identifiers of the end device, a "local storage object" or a signature created from various automatically transmitted information from your browser to recognize computer systems. This identifier is unique to a browser as long as the cookie or Local Storage Object is not deleted. Measurement of the data and subsequent assignment to the respective client identifier is therefore also possible when you call up other websites that also use the measurement procedure of INFOnline GmbH. The shortened client IP, User Agent Advertising Identifier, Installation ID, Android ID and Vendor ID can be transmitted as unique identifiers as a hash to INFOnline GmbH.
The validity of the cookies used is limited to a maximum of 1 year.

3.3.4.2. Use of the data

The measurement procedure used by INFOnline GmbH on this website determines usage data. This is done in order to collect the performance values page impressions, visits and clients.

A so-called geolocation, i.e. the assignment of a web page call to the location of the call, is performed exclusively on the basis of the anonymized IP address and only down to the geographic level of the federal states/regions. Under no circumstances can conclusions be drawn about the specific location of a user from the geographical information obtained in this way.

The usage data of a technical client (e.g., a browser on a device) is aggregated across websites using the pseudonymous measurement method (IOMp) and stored in a database.

3.3.4.3. Storage period of the data

The complete IP address is not stored by INFOnline GmbH. The IP address is only used to receive the data packets and is then shortened by 1 byte.

The shortened IP address is stored for a maximum of 60 days. The usage data in connection with the unique identifier are stored for a maximum of 6 months.

3.3.4.4. Passing on data

The IP address as well as the shortened IP address are not passed on by INFOnline GmbH.

Legal basis: consent (Art. 6 Para. 1 a) GDPR, Sec. 25 Para. 1 TTDSG).

The purpose of processing personal data is to form digital performance values (page impression, visit and technical client) in order to create statistics. The statistics are used to be able to track and prove the use of our offer.

AutoScout24 Germany uses the Mouseflow program on our websites, a web analysis tool from Mouseflow ApS (Flaesketorvet 68, 1711 Copenhagen, Denmark; "Mouseflow"), to record randomly selected individual visits (with anonymized IP address). This creates a log of mouse movements and clicks with the intention of randomly replaying individual website visits and deriving potential improvements for the website. The recorded information is not personal and will not be shared.

You can find more information about Mouseflow's data protection here: https://mouseflow.com/legal/company/privacy-shield/.

Legal basis: consent (Art. 6 Para. 1 a) GDPR, Sec. 25 Para. 1 TTDSG).

AutoScout24 Germany uses Optimizely, a web analytics service provided by Optimizely, Inc. (631 Howard St. Suite 100, San Francisco, CA 94105; "Optimizely") on our websites. Optimizely uses cookies to help analyze how you use our website. The information generated by the cookie about your visit to the website is usually transmitted to and stored by Optimizely on servers in the United States. Your IP address is first anonymized before being stored by Optimizely, so that it is impossible to relate the transferred data to a specific person. Your use of our website is evaluated by AutoScout24 Germany via the Optimizely tool in order to compile reports on website activities. AutoScout24 Germany also has the option of using the tool to carry out so-called A/B tests in particular, which can be used to identify which versions of our websites you like best.

You can find more information about Optimizely's data protection here: https://www.optimizely.com/legal/privacy-policy/.

The advertising on our services is optimized for you by processing your usage behavior based on predicted interests. Cookies and function-similar technologies are used for this purpose, which are stored in the memory of your Internet browser or (mobile) end device and enable recognition.

Data is collected about your activities on our services (e.g., advertising banners clicked, sub-pages visited, search queries made, etc.). This data is used by means of pseudonymous data by third parties for the purpose of displaying content and advertising that matches your interests.

When you enter your email address on our website or app to sign up or make electronic contact with an advertiser, we may share personal or other data we collect from you, such as your email address (in hashed, pseudonymized form), your IP address, or information about your browser or operating system with our online ID partners. Our partners use this information to create an online ID with which you can be recognized on the devices you use.

These processing operations are carried out based on your consent pursuant to Art. 6 Para. 1 a) GDPR towards AutoScout24 Germany. Your consent is obtained through the AutoScout24 Privacy Manager, which AutoScout24 Germany displays when you visit our services and by means of which you can set your preferences for the use of your personal data. As part of these processing operations, AutoScout24 Germany also carries out the transaction data on the websites and in the mobile apps from AutoScout24 (pages viewed, content clicked on, etc.) and data from other services used on these websites / in these apps together with your registration data in order to be able to show you interesting advertising services on these websites / in these mobile apps.

For the delivery of usage-based online advertising, we use different operators of advertising networks under these conditions.

We work with the following partners in this regard:

3.4.1.1. Google Ads

AutoScout24 Germany uses Google Ads on our websites, a service of Google Ireland Limited (Google Building Gordon House, Barrow St, Dublin 4, Ireland; "Google"). Google Ads is an Internet advertising service that allows advertisers to place ads both in Google's search engine results and in the Google advertising network. Google Ads allows an advertiser to specify certain keywords in advance, by means of which an ad is displayed in Google's search engine results exclusively when the user retrieves a keyword-relevant search result using the search engine. In the Google advertising network, the ads are distributed on topic-relevant websites by means of an automatic algorithm and in compliance with the previously defined keywords.

The purpose of Google Ads is to promote our website by displaying interest-relevant advertisements on the websites of third-party companies and in the search engine results of Google's search engine and to display third-party advertisements on our website.

If a data subject accesses our website via a Google ad, a so-called conversion cookie is stored on the data subject's information technology system by Google and user data based on pseudonymized, hashed email addresses is used as an online ID. A conversion cookie loses its validity after thirty days and is not used to identify the data subject. The conversion cookie is used to track whether certain subpages, for example the shopping cart from an online store system, have been called up on our website, provided that the cookie has not yet expired. Through the conversion cookie, both we and Google can track whether a data subject who accessed our website via a Google Ads ad generated a sale, i.e. completed or cancelled a purchase of goods.

The data and information collected through the use of the conversion cookie are used by Google to create visit statistics for our website. These visit statistics are in turn used by us to determine the total number of users who were referred to us via Google Ads ads, i.e. to determine the success or failure of the respective Google Ads ad and to optimize our Google Ads ads for the future. Neither our company nor other Google Ads advertisers receive information from Google by means of which the data subject could be identified. By means of the conversion cookie, personal information, for example the websites visited by the data subject, is stored.

By means of the conversion cookie, personal information, for example the internet pages visited by the data subject, is stored. Each time the data subject visits our website, personal data, including the IP address of the internet connection used by the data subject, is transmitted to Google in the USA. This personal data is stored by Google in the USA. Google may pass on this personal data collected via the technical procedure to third parties.

Legal basis: consent (Art. 6 Para. 1 a) GDPR, Sec. 25 Para. 1 TTDSG).

3.4.1.2 Google Ad Manager

Google Ad Manager 360 is a service provided by Google Ireland Limited (Google Building Gordon House, Barrow St, Dublin 4, Ireland; "Google"). Google Ad Manager 360 uses cookies and user data based on pseudonymized, hashed email addresses as an online ID to present you with ads that are relevant to you. In doing so, a pseudonymous identification number (ID) is assigned to your browser in order to check which ads were displayed in your browser and which ads were called up. The use of Ad Manager 360 cookies and user data based on pseudonymous hashed email addresses only allows Google and its partner websites to serve ads based on prior visits to our website or other websites on the Internet. The information generated by the cookies and user data based on pseudonymized, hashed email addresses is transmitted by Google to a server in the USA for analysis and stored there. A transfer of data by Google to third parties only takes place due to legal regulations or within the framework of order data processing. Under no circumstances will Google combine your data with other data collected by Google.

Legal basis: Einwilligung, Art. 6 Abs. 1 a) DSGVO, § 25 Abs. 1 TTDSG.Oconsent (Art. 6 Para. 1 a) GDPR, Sec. 25 Para. 1 TTDSG).

You can download this here: https://support.google.com/ads/answer/7395996.In addition, you have the option to permanently object to interest-based advertising by Google if you use a Google account. • Facebook

    Pixel and iOS & Android Facebook SDK: To evaluate and support our online marketing measures on or via Facebook, a so-called "Facebook tracking pixel" is integrated on our websites, which is provided and evaluated by Meta Platforms Ireland Limited (4 Grand Canal Square, Grand Canal Habour, Dublin D02X525, Ireland, "Facebook"). When you visit our platform, the tracking pixel establishes a direct connection between your browser and the Facebook server. Facebook thereby receives, among other things, the information from your browser that our website was accessed from your end device. In our mobile apps for iOS and Android, the "Facebook SDK" is also integrated. When you use our apps, a direct connection between your smartphone and the Facebook server is established via the Facebook SDK. Facebook thereby receives, among other things, the information that our app was used by your end device. If you are a Facebook user, Facebook can assign the visit to our pages and apps to your user account. Likewise, Facebook can subsequently recognize whether a Facebook ad has had an effect, e.g. has led to an online purchase.

    We only receive statistical data from Facebook for this purpose without any reference to your specific person. This is done for the purposes of advertising effectiveness, market research and user-oriented design of our website and apps. This also occurs, at least in part, outside the territorial scope of EU data protection regulations.

    Custom Audience via pixel method: A Facebook tracking pixel is embedded on our website. In our mobile applications for iOS and Android, the Facebook SDK is also integrated. With the help of this pixel and the SDK, Facebook can track the user's browsing behavior on the website and within the app. Based on your browsing behavior, Website Custom Audiences can be created in Facebook Audience Manager to classify you based on your browsing behavior. These formed Website Custom Audiences can then be used in remarketing or lookalike campaigns. An example of this is if you were visiting the website to place a particular order, but would abandon it. You would subsequently fall into a "dropout audience" and be retargeted in a Facebook remarketing campaign.

    Audience Network: We also use Facebook's Audience Network to support our online marketing efforts. The Audience Network facilitates the placement of third-party advertisements and/or Facebook ads or other commercial or sponsored content ("Ads") on our Platform, as well as in our mobile applications, mobile websites and video players.

    If you are a Facebook user, Facebook may associate your visit to our Sites and Apps with your user account through a pixel ID, the Facebook SDK, a Facebook cookie, or pseudonymized hashed user data based on your email address (also known as an online ID). As a Facebook member, you can also edit your account settings at https://www.facebook.com/ads/website_custom_audiences/ and use them to object to data collection via Custom Audiences across devices.

This data processing is carried out based on our legitimate interests pursuant to Art. 6 Para. 1 f) GDPR in the exchange of data for the aforementioned purposes with companies in which AutoScout has a shareholding.

It may happen that we also pass on your data to other recipients within the scope of the above-mentioned purposes. For example, as part of the provision of the offer and the associated functions and services, we pass on your data to providers and interested parties of cars and their financing, provided that you make use of the respective service.

Exceptionally, there may also be situations in which we are required by law to disclose your personal data to third parties, for example in the context of government law enforcement measures. In the event of an objectionable misuse of the AutoScout24 platform, the prerequisite for passing on data to other users is that there are justified and documented indications of the misuse.

In addition, your personal data may be passed on within the AutoScout24 group of companies, to service companies (possibly also third countries), to government authorities and to persons affected by a violation of the law and possibly to other companies as part of a corporate transaction, as explained in detail below.

4.1 Disclosure within the AutoScout24 group of companies

AutoScout24 operates internationally and is part of the AutoScout24 group of companies. Certain personal data, such as data provided by the user during registration, may be passed on within the group of companies for internal administrative purposes, including joint customer support, to the extent necessary.

4.2 Transfer to service providers bound by instructions

In some cases, we use service providers bound by instructions (both companies of the AutoScout24 group of companies and external service providers) for certain data processing activities. These are, without exception, service companies bound by instructions, which process the data on our behalf and according to our instructions.

4.3 Transfer to independent service providers

We offer some of our services in cooperation with independent service providers. These service providers are not bound by our instructions but are in turn independent controllers for processing the data they receive from us. This is the case, for example, if you choose the car loan, car insurance or leasing functions. In such cases, AutoSout24 acts only as an intermediary and for this purpose passes on data to an independent service provider who in turn provides a service to you. We will inform you about the passing on of personal data to independent service providers in the context of entering data to be passed on.

4.4 Disclosure to government agencies, to injured parties and for legal prosecution

If it is necessary to clarify illegal or abusive use of AutoScout24 or for legal prosecution, personal data will be forwarded to the law enforcement authorities and, if necessary, to injured third parties. However, this only happens if there are indications of unlawful or abusive behavior. A transfer may also take place if it serves the enforcement of terms of use or other agreements. We are also legally obligated to provide information to certain public authorities upon request. These are law enforcement agencies, authorities that prosecute administrative offenses subject to fines and the tax authorities.

4.5 Disclosure in the context of corporate transactions

As our business evolves, we may change the structure of our company by changing its legal form, establishing, buying or selling subsidiaries, divisions or components. In such transactions, customer information may be transferred to the acquirer or legal successor along with the part of the company being transferred. In any transfer of personal information to third parties to the extent described above, we will ensure that this is done in accordance with this Privacy Notice and applicable data protection law.

Any disclosure of personal data will be made on the basis of the statutory provisions. Accordingly, this data processing is justified by the fact that (1) the processing is necessary for the performance of the contract for the use of AutoScout24, or (2) AutoScout24 has a legitimate interest in disclosing the data for administrative purposes or the processing is necessary for compliance with a legal obligation to which AutoScout24 is subject.

5.1 Protection of your data in the third country

Due to the aforementioned transfers, the service providers bound by instructions may process the data in countries outside the EU ("third countries").

Insofar as AutoScout24 Germany or AutoScout24 transfers your personal data to a third country, appropriate guarantees are provided in accordance with Art. 44 ff. GDPR. With recipients in third countries for which there is no Commission adequacy decision, we have concluded the EU standard contractual clauses (or standard data protection clauses) in accordance with Art. 46 Para. 2 c) GDPR. A copy of the clauses can be found here (2010/87 Commission Decision of 5 February 2010) and here (2021/914 Commission Implementing Decision of 4 June 2021).

5.2 Consent to the transfer to third countries when using cookies

Personal data that we collect through the use of cookies on our website or app is transferred to several third countries where we cannot adequately protect your data even by entering into standard contractual clauses. We therefore only transfer the data collected via cookies to third countries if you consent to the transfer (Art. 49 Para. 1 a) GDPR). In order for you to understand the risks involved, we ask that you review the following information in advance.

We cannot effectively protect your personal data from access by intelligence agencies or investigative authorities in the third country. Rights and protections that apply to the processing of your data in Europe are not available or are limited in third countries. This could mean that you have no recourse against measures taken by authorities in third countries. It is possible that there are no special requirements for the protection of your personal data in the third country. Accordingly, in most third countries there are also no data protection supervisory authorities to supervise whether the data is processed in accordance with data protection principles by the recipient within the third country or to ensure that you can exercise your data subject rights.

Especially in respect to the transfer of personal data to the U.S., the Court of Justice of the European Union has declared that your data will be insufficiently without additional measures that protect your data within the third country. Thus, U.S. intelligence agencies may be entitled to challenge your data with one of the third-party providers or intercept it during transmission. If this occurs, U.S. law does not provide you with any legal recourse against the intelligence agencies authority. According to the U.S. government, such actions should only occur in exceptional circumstances.

10. Joint controllership Auto Abo AutoScout24 Germany arranges services via our Auto Abo service for you together with AS24 Subscription, Imove and the vehicle providers (see section 1.3). We therefore also jointly guarantee the protection of your personal data.

10.1 When does joint controllership exist?

When you use our "Auto Subscription" service, for example by accessing the corresponding subpage of our website, the data that AutoScout24 Germany collects as part of the tracking process is also passed on to AS24 Subscription, Imove and, in some cases, to the vehicle providers.

Imove and AS24 Subscription support AutoScout24 Germany in providing the technical infrastructure needed to offer you car subscriptions. For the operation and optimization of the platform set up for this purpose, the companies involved exchange your personal data.

In addition, the car providers receive anonymous overviews of the use of the platform from AutoScout24 Germany. Data is further exchanged with the providers in order to determine whether we were able to place you successfully.

10.2 What does this mean for me?

As part of their joint controllership under data protection law, all participating companies have agreed on who fulfills which obligations of the GDPR. This relates in particular to the exercise of the rights of the data subjects and compliance with the information obligations pursuant to Articles 13 and 14 GDPR.

It was agreed that AutoScout24 Germany will inform you about the processing of your data and ensure that you can assert your data subject rights at any time. You can simply contact AutoScout24 Germany directly regarding your rights. Irrespective of this, however, you are free to assert your rights with one of the other companies involved via their respective business address.

If you wish to purchase or have purchased a car through smyle, smyle is the independent controller for processing your personal data (see section 1.5). In the context of providing services, smyle also cooperates with Autoscout24 Germany. In part, the processing of your personal data is therefore the joint controllership of smyle and AutoScout24 Germany.

In the following, we would like to inform you in detail about which data processing is carried out by smyle as an independent controller and to what extent the processing of your data is carried out within the scope of joint controllership with AutoScout24 Germany.

11.1 For what purposes and on what legal basis does smyle process your data as an independent controller?

  • the sale of vehicles;
  • the registration of vehicles;
  • the processing of provisional motor vehicle liability and insurance;
  • the delivery of the vehicle;
  • the provision of a breakdown service;
  • the provision of warranty insurance;
  • handling vehicle financing, if applicable and
  • if applicable, execution of payment processing (cash purchase).

The legal basis for data processing is the contract agreed between smyle and you pursuant to Art. 6 Para. 1 b) GDPR.

Under certain circumstances, smyle may also be legally obligated to process your personal data, e.g. in order to be able to fulfill defect rights asserted by you (Sec. 437 BGB). Furthermore, smyle may be required to retain your personal data for a certain period of time due to legal obligations under tax and commercial law (see section 11.3). In individual cases, smyle may also be obligated to hand over your data as part of an official investigation.

The legal basis for data processing in these cases is in each case the compliance with the relevant legal obligation pursuant to Art. 6 Para. 1 c) GDPR.

11.2 The legal basis for data processing in these cases is in each case the compliance with the relevant legal obligation pursuant to Art. 6 Para. 1 c) GDPR.

In principle, AutoScout24 Germany is the independent controller with regard to processing that takes place in the context of providing the website and managing customer accounts. Data processing by smyle only takes place if

  • you use the order section integrated on the pages of AutoScout24 Germany in order to make use of smyle services;
  • you place an order with smyle using an AutoScout24 account.

In this respect, smyle and AutoScout24 Germany process your data as joint controllers.

The legal basis for the data processing is the performance of a contract or in order to take steps at the request of the data subject prior to entering into a contract pursuant to Art. 6 Para. 1 b) GDPR and legitimate interests pursuant to Art. 6 Para. 1 f) GDPR. The legitimate interest is to be able to provide you with an optimized and functional ordering process and digital contract management via the customer account.

This information may be provided to you by AutoScout24 Germany or smyle through various channels such as email, telephone, SMS, postal mail and third party social networks.

If you have consented to this, AutoScout24 Germany or smyle will process the data based on consent pursuant to Art. 6 Para. 1 a) GDPR. In individual cases, the processing is based on Art. 6 Para. 1 f) GDPR and the legitimate interest to advertise products of AutoScout24 Germany and/or smyle, provided you have not objected to the processing of your personal data for advertising purposes.

Data processing in connection with the provision of customer support and the implementation of data subject rights in relation to smyle products and services is carried out by smyle under joint controllerhsip with AutoScout24 Germany.

The legal basis for this is Art. 6 Para. 1 b) GDPR (in the case of inquiries regarding the contractual relationship), Art. 6 Para. 1 c) GDPR (in the case of the assertion of data subject rights) and our legitimate interest in responding to your inquiries pursuant to Art. 6 Para. 1 f) GDPR.

11.3. Recipients to whom the personal data are enclosed

smyle or AutoScout24 Germany will pass on your personal data to the following recipients to the extent necessary:

In addition, smyle or AutoScout24 Germany cooperates with lawyers and consultants who provide support as needed in the implementation of legal obligations.

11.4. How long do we store your data?

smyle deletes or anonymizes your personal data as soon as it is no longer required for the above-mentioned purposes for which smyle processes it. The specific storage period depends on the particular smyle service used. If you use smyle services without an AutoScout24 account, smlye will store your personal data for the duration of your use of smyle services plus a period of up to 7 days, unless this data is needed longer for criminal prosecution or to secure, assert or enforce legal claims.

If you use smyle services with an AutoScout24 account, smyle will store your personal data for the duration of your registration and delete it as soon as you delete your account. smyle will, however, retain backup copies of your data for a period of up to 14 days before these are also permanently deleted. In the event that you have given your consent to the processing of your personal data (e.g. for the purpose of advertising, including the associated profiling), smyle or AutoScout24 Germany will store your personal data until you withdraw your consent. If smyle is required to retain data for legal reasons, the deletion will be replaced by a restriction on the further processing of the data concerned. This applies in particular to the retention of personal data about you for reasons of tax law in accordance with Sec. 147 AO for a period of six or ten years from the end of the calendar year in which you purchased a vehicle as part of our "smyle" offer. In parallel, smyle is obligated to store your personal data after the purchase of a vehicle within the scope of our "smyle" offer until the limitation of your warranty rights (Sec. 438 Para. 1 No. 3 and Para. 2 BGB) from the delivery of the vehicle to you.

11.5. What rights do you have as a data subject?

As a data subject, you have the rights listed in section 7. All data subject inquiries are processed and managed centrally. You can therefore assert your rights with regard to processing by smyle directly against smyle or alternatively contact AutoScout24 Germany.

Withdrawal of consent and objections to processing can also be addressed centrally to widerspruch@autoscout24.de

11.6. What does joint controllership mean for me as a data subject?

As described in detail in Section 11.2, smyle and AutoScout24 Germany carry out some processing as joint controllers. For this purpose, a contract was concluded that primarily specifies who fulfills which obligations under the GDPR.

Therefore, it was agreed that AutoScout24 Germany will inform you about the processing of your data and ensure that your data subject requests are processed and fulfilled in accordance with the legal requirements.

AutoScout24's services are constantly being developed, in particular to further improve the services and functionalities of the platform. Such changes may also affect the use of your personal data. We will therefore adapt this data protection information accordingly from time to time. The latest version is available on our website under the heading "Data Protection Information".
