Data Protection Information for the Application Process

Your privacy is very important to us. We want you to be able trust us with regard to the processing of your personal data. For that reason, we and our data protection officer ensure that the data will only be processed within the legal framework of the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). We therefore also want to inform you on how we process your personal data during application procedures and how you can exercise your rights in relation to the processing of your personal data.

The career portal is made available by AutoScout24 GmbH, Tölzer Straße 16, 82031 Grünwald, legally represented by the managing directors Peter Brooks-Johnson, Biliana Alabatchka and Michael Luhnen (“AutoScout”, “we” or “us”) as data controller within the meaning of the applicable data protection law. AutoScout is the data controller for the data processing in context of the application process.

We mainly process personal data that you provide to us within the application process. We only process your data in the context of the application procedure, especially to find and hire a suitable candidate for an opening. Legal base for the processing is Art. 6 para. 1 lit. b) GDPR in conjunction with § 26 para. 1 sentence 2 BDSG.

We may also process information about your person that is not mandatory but still important for the application process based on Art. 6 para. 1 lit f) GDPR and our legitimate interest in considering all relevant information when evaluating the job application.

We also use your personal data to evaluate the performance of our job advertisements and to optimise the application process. Legal base for the processing is Art. 6 para. 1 lit f) GDPR and our legitimate interest in optimizing procedures based on evaluations.

In addition, you may consent in the processing of your personal data for further purposes, e.g. consideration of your application for future openings or extended storage. The legal base for that processing will be Art. 6 para. 1 a) GDPR.

In the event of a legal dispute, we will also process your data for the assertion, exercise or defence of legal claims. In this case, the legal basis for the data processing is Art. 6 para. 1 lit. f) GDPR. We also may be legally obliged to process your data, e.g. in accordance with § 147 of the German Fiscal Code and § 257 of the German Commercial Code. If this is the case, the processing will be based on Art. 6 para. 1 lit. c) GDPR.

Which data we collect and process will vary on the position offered. Our job vacancies always include a candidate profil, which includes description of the job requirements. Information that is required within the entry form is marked with an asterisk (*). You are of course welcome to provide us further information about yourself if you consider it relevant for the application process.

Before you apply, please take a good look at the candidate profil so you know exactly which information is required to apply. As a rule, we request the following information:

  • Information regarding the position you are applying for;
  • Name
  • E-mail address;
  • Telephone number;
  • Place of residence;
  • Curriculum vitae;
  • Education and training;
  • URL of LinkedIn profile;
  • Information on whether a work permit and visa would be required and/or you would need to relocate;
  • Salary expectation;

Certain positions might also require you to provide further information in relation to specific skills (e.g. language skills).

If you apply to us by e-mail we might revert back to you to and ask you for further information to complete your application.

Legal base for the processing of mandatory information is Art. 6 para. 1 lit. b) GDPR in conjunction with § 26 para. 1 sentence 2 BDSG. Other information provided by you or collected by us will be processed based on Art. 6 para. 1 lit f) GDPR and our legitimate interest in considering all relevant information when evaluating the job application. We might consider publicly available data in individual cases. In this case, the data processing is also based on our aforementioned legitimate interests.

In the event of suspected fraud, we might analyse the log files to clarify discrepancies. The data processing that takes place for this purpose is based on our legitimate interests in the clarification of suspected fraud and inconsistencies in accordance with Art. 6 para. 1 lit. f) GDPR.

LinkedIn is an employment-oriented online social-network provided by the LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland. If you like, you can use our website to apply with your existing LinkedIn-Profile. Just click the "Apply with LinkedIn" button on our website. After clicking the button, information from your LinkedIn profile is loaded and inserted into the application form. It is possible for you to adjust and supplement the information loaded from LinkedIn.

In individual cases, recruiters support us during the application process. They collect your personal data as independent data controllers (Art. 4 no. 8 GDPR) and pass it on to us. If we should receive data from a recruiter, you will receive additional information from us or the recruiter.

Different service providers support us during the processing of your application data. The technical platform for managing applications is operated by Greenhouse (Greenhouse Software, Inc.,18 West 18th Street, 11th Floor New York, NY 10011, USA). We have signed standard data protection clauses with Greenhouse to protect your data when it is transferred outside the EU / EEA.

Furthermore, it is also possible that you apply to us with your LinkedIn profile and that LinkedIn thereby receives information about your application.

We will store the information you provide for the duration of the application process.

If the application process is successful, your data will become part of the personnel file, as far as this is necessary and permissible, and stored during your employment with us.

If your application is unfortunately unsuccessful, your data will usually be stored for a maximum of 6 months after completion of the procedure. After this period, your information and documents will be deleted or returned to you.

If you have given us your consent to retain data after the application process has been completed, we will delete the data if we do not have a suitable opening for you in the foreseeable future or if you should withdraw your consent.

In addition, we also retain your data after the application process if

  • we have reason to expect that further retention of your data might be necessary because of a future legal dispute with you,
  • a legal dispute with you is certainly imminent, or
  • a legal dispute with you is already taking place.

Your data will be stored until the conclusion of the related legal dispute and the expiry of any applicable retention periods.

We guarantee that you can exercise your data subject rights.

If you have given us your consent to process your data, you can withdraw it at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal and will only affect current or future processing of your data. According to Art. 21 GDPR you have the right to object the processing of your personal data based on Art. 6 (1) f) GDPR at any time for reasons arising from your particular situation.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing, which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

The GDPR also grants you the following rights with regard to the processing of your personal data as long as the legal requirements are met:

  • Right of access, Art. 15 GDPR;
  • Right to rectification, Art. 16 GDPR;
  • Right to erasure, Art. 17 GDPR;
  • Right to restriction of processing, Art. 18 GDPR and
  • Right to data portability, Art. 20 GDPR.

You also have the right to lodge a complaint with a supervisory authority if you believe that the processing of personal data concerning you is in breach of the GDPR.

We keep our privacy notice under regular review to make sure it is up to date and accurate.
